Terms & Conditions

Article 1: Completeness

The present general conditions express the “entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation the “entirety of the provisions set out in these general conditions of sale. For its part, La Coutellerie Brun undertakes to respect its role as a retailer within the framework of these conditions.

Article 2: Purpose

The purpose of these terms and conditions is to define the rights and obligations of the parties in connection with the online sale of products offered by the cutlery Brun

Article 3: Acceptance of these terms and conditions

The fact that a user fills in the order form on the site and confirms the order (by clicking on the button ” Order Confirmation ” provided for this purpose), implies full acceptance of these Terms and Conditions, which will be solely applicable to the contract thus concluded.

Article 4: Product prices

Prices are indicated in Euros and are only applicable “on the date of “sending of order validation by the consumer.
They do not include delivery charges, which are invoiced in addition and indicated before the final validation of the order. La Coutellerie Brun reserves the right to charge the consumer a contribution towards the cost of postage below a certain order threshold. This threshold and the contribution required are clearly stipulated on the Coutellerie-brun.fr website.
Prices take into account the VAT applicable on the day of the order, and any change in the legal VAT rate will automatically be reflected in the price of the products presented on the site, on the date stipulated by the implementing decree.

Article 5: Order confirmation

Contractual information will be confirmed by e-mail to the address indicated by the consumer on the order form.

Article 6: Method of payment

To pay for the order, the consumer has the choice of “all the methods of payment indicated on the order form, i.e.: credit card, cheque. Orders paid for by cheque will only be processed on receipt of payment. Availability and dispatch times are recalculated from the date of receipt of payment.
Cheques are cashed as soon as the order is validated. The Company uses the Paypal security service. Confidential data relating to the means of payment are not accessible by the Seller, but are managed directly by the security service. The consumer guarantees La Coutellerie Brun that “he/she has the necessary authorizations to use the method of payment chosen by him/her when validating the order form.
La Coutellerie Brun reserves the right to suspend any order and any delivery in the event of refusal of “authorization of payment by credit card from the officially accredited bodies or in the event of non-payment.
In particular, La Coutellerie Brun reserves the right to refuse to “make a delivery or to “honour an order from “a consumer who has not “paid in full or in part for a previous order or with whom a payment dispute is being “administered.
La Coutellerie Brun retains full and complete ownership of the products sold until full payment has been received for all sums due by the consumer in connection with the order, including all costs and taxes.

Article 7: Product availability

The order will be executed at the latest within 30 days from the day following that on which the consumer’s order has been definitively validated (payment received and order verification procedure completed).
In the event of “unavailability of the product ordered, in particular due to our suppliers, the consumer will be informed as soon as possible and will have the opportunity to “cancel his order. The consumer will then have the choice of requesting either a refund, if applicable, of the sums paid within 30 days at the latest of their payment, or an exchange of a product of equivalent characteristics and price, if La Coutellerie Brun is able to obtain it.
If an exchange is not possible, La Coutellerie Brun reserves the right to cancel the customer’s order and reimburse the sums paid.

Article 8: Delivery terms

Products are delivered to the address indicated by the customer on the order form and only in the geographical areas we serve.
All products leave our premises in perfect condition. It is the customer’s responsibility to notify the carrier (or letter carrier) of the slightest trace of impact (holes, traces of crushing, etc.) on the parcel, and if necessary to refuse the parcel. A new identical product will then be returned to you free of charge.
We will not accept the exchange of any product that has been declared damaged in transit, without any reservation having been made on receipt of the parcel.
As with any shipment, it is possible for there to be a delay or for the product to go astray. In such a case, we contract the carrier to start an investigation. Every effort is made, for as long as necessary, to find this parcel. In this case, the retailer will be reimbursed by the carrier and will deliver a new identical parcel at its own expense.
We accept no responsibility for longer delivery times caused by the carrier, particularly in the event of loss of products, bad weather or strikes.

Article 9: Right of withdrawal

In accordance with article L121-16 of the French Consumer Code, you have 7 working days to return the goods to the following address: Coutellerie brun 7, rue Bardière 12210 Laguiole. Return costs are at the customer’s expense. Items must be returned in their original packaging, undamaged and in perfect condition for resale, mentioning the reason for the return on the invoice, within 30 (thirty) days.

Article 10: Product warranty

The provisions hereof shall not deprive the consumer of the legal warranty which obliges the professional seller to guarantee the consumer against all consequences of hidden defects in the item sold.
The consumer is expressly informed that Coutellerie Brun is the manufacturer of the products presented on www.coutellerie-brun.fr, with the exception of accessories, cases, guns, and other items not “being knives and that Coutellerie Brun disclaims all liability for defective products.

All our knives are guaranteed for life against manufacturing defects under “normal use. All modified or repaired products are excluded from this warranty.

Article 11: Force majeure

Neither party “will have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by a fortuitous event or force majeure.
Acts of God or force majeure shall be deemed to be any facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonable efforts.
The party affected by such circumstances will notify “the other within ten working days of becoming aware of them.
The two parties will then meet, within a period of “one month, unless this is impossible due to force majeure, to examine the “impact of the “event and agree on the conditions under which the “performance of the contract will be continued.
If the case of force majeure lasts longer than three months, the present terms and conditions may be terminated by the injured party.
The following are expressly considered as cases of force majeure or fortuitous events, in addition to those generally accepted by the jurisprudence of French courts and tribunals:
– blockage of transport or “supplies, earthquakes, fires, storms, floods, lightning;

  • l “stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers.

Article 12: Partial non-validation

If one or more stipulations of the present terms and conditions are held to be invalid or declared as such in application of “a law, “a regulation or following “a final decision of “a competent court, the other stipulations will retain all their force and scope.

Article 13: Non-waiver

The fact that “one of the parties does not avail itself of “a breach by the “other party of “one of the obligations referred to in these general terms and conditions shall not be interpreted for “future as a waiver of the “obligation in question.

Article 14: Title

In the event of any difficulty of “interpretation between “one of the titles appearing at the head of the clauses, and “one of the clauses, the titles will be declared non-existent.

Article 15: Applicable law

These terms and conditions are governed by French law. This applies to both substantive and formal rules.
In the event of a dispute or claim, the consumer should first contact La Coutellerie Tourangelle for an amicable solution.

Article 16: Data protection

In accordance with the French law ” Informatique et libertés ” n°78-17 of January 6, 1978, you have “a right of access and rectification to “data concerning you. You can exercise this right by sending us a letter.
